Plaintiff Donna Jones ("Plaintiff") commenced the instant action pursuant to Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. Â§ 2000e, et seq. ("Title VII"), the Age Discrimination in Employment Act, 29 U.S.C. Â§ 621 et seq. ("ADEA"), and the New York Human Rights Law, N.Y. Exec. Law Â§ 296 ("HRL"), arising out of her employment with Defendant Smithkline Beecham Corporation d/b/a Glaxo Smith Kline ("GSK"). Currently Page 2 before the Court is Defendants motion for summary judgment pursuant to Fed.R.Civ.P. 56 seeking dismissal of the Complaint in its entirety. Plaintiff has cross-moved for leave to file an amended complaint alleging a claim of constructive discharge. This latter motion was initially referred to the assigned magistrate judge for resolution, but is addressed herein.
