Plaintiff Donna Jones ("Plaintiff") commenced the instant action pursuant to Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e, et seq. ("Title VII"), the Age Discrimination in Employment Act, 29 U.S.C. § 621 et seq. ("ADEA"), and the New York Human Rights Law, N.Y. Exec. Law § 296 ("HRL"), arising out of her employment with Defendant Smithkline Beecham Corporation d/b/a Glaxo Smith Kline ("GSK"). Currently Page 2 before the Court is Defendants motion for summary judgment pursuant to Fed.R.Civ.P. 56 seeking dismissal of the Complaint in its entirety. Plaintiff has cross-moved for leave to file an amended complaint alleging a claim of constructive discharge. This latter motion was initially referred to the assigned magistrate judge for resolution, but is addressed herein.
