Danny Jones brought this action pursuant to 42 U.S.C.A. § 1983 (West 1994), claiming that his First Amendment rights were violated when Sheriff Harold Plaster failed to reappoint Jones as a deputy sheriff following Plasters election. Jones appeals the judgment of the district court entered following a jury trial that resulted in a verdict for Plaster, arguing that the district court applied an incorrect legal standard in ruling on his claim that Plaster unconstitutionally exercised a peremptory strike of a juror and that the district court erred in charging the jury. We find no error in the jury instructions; however, we remand for further proceedings with respect to the jury selection issue.
